Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Plutyx platform operated by Plutyx ("we", "us", or "our"). By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing the platform, or using the API, you confirm that you are at least 16 years old, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy.

2. Description of Service

Plutyx is a B2B lead intelligence platform that provides:

• Email finder and domain search tools
• Company enrichment and technology detection
• Google Maps business data extraction
• Outreach sequence automation
• AI-powered cold email generation
• REST API access for programmatic lead generation

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately at support@plutyx.com if you suspect unauthorized access.

4. Acceptable Use

You agree to use Plutyx only for lawful B2B prospecting and lead generation purposes. You must not:

• Use the platform to send unsolicited bulk email (spam) in violation of applicable law (CAN-SPAM, GDPR, CASL, etc.).
• Scrape, copy, or redistribute data from the platform for resale or to build competing products.
• Attempt to reverse-engineer, decompile, or access the platform's source code or infrastructure.
• Use automated scripts to abuse the API beyond your plan's rate limits.
• Collect or process personal data of individuals without a valid legal basis under applicable privacy law.
• Use the service to target individuals under 16 years of age.
• Impersonate any person, company, or entity.

5. API Usage and Rate Limits

Each plan includes a monthly quota of API credits. Unused credits do not roll over. Exceeding your quota will result in requests being rejected with HTTP 429 until the next billing cycle. We reserve the right to throttle or suspend accounts that abuse the API or attempt to circumvent rate limits.

6. Subscription Plans and Billing

Plutyx offers Free, Starter, Pro, and Agency plans billed monthly or annually. All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period with no pro-rata refunds. We reserve the right to modify pricing with 30 days' written notice.

7. Data You Process

You are solely responsible for ensuring that your use of Plutyx-sourced data complies with applicable privacy laws (including GDPR, CCPA, and similar regulations). You must:

• Have a legitimate interest or other lawful basis for processing any personal data obtained through the platform.
• Honor opt-out and unsubscribe requests promptly.
• Not use data to discriminate against protected classes or violate any anti-discrimination law.

8. Intellectual Property

All software, algorithms, UI design, documentation, and brand assets of Plutyx are our exclusive intellectual property. Nothing in these Terms grants you ownership of or license to our IP beyond the limited right to use the service as described herein. Content you create (lead lists, sequences) remains yours; you grant us a limited license to store and process it solely to provide the service.

9. Availability and Uptime

We aim for 99.5% monthly uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance where possible. We are not liable for losses arising from downtime, data loss due to infrastructure failures, or interruptions caused by third-party providers (AWS, Google Cloud, Stripe).

10. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy of data, or non-infringement. Lead data is sourced from public sources and third-party providers; we do not guarantee its completeness or accuracy.

11. Limitation of Liability

To the maximum extent permitted by law, Plutyx's total liability for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid in the three months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

12. Indemnification

You agree to indemnify and hold harmless Plutyx and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third party's rights.

13. Termination

We may suspend or terminate your account immediately, without notice, if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the service ceases. You may export your data before account closure by contacting support@plutyx.com.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Brazil, without regard to conflict of law provisions. Any disputes shall be resolved by the courts of competent jurisdiction in Brazil.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the service after that date constitutes acceptance of the revised Terms.
